KCC 1063/2013

This case involved whether a member of a cooperative association board who was dismissed and reappointed had received sufficient compensation as their legal costs were paid.

Background

The documents of the case revealed that the court had concluded that the appellant did not deserve material compensation.

Decision

The court said that the court had established its ruling on the grounds that the administrative authority executed the ruling which dismissed the dismissal of the general assembly of the cooperative association. The court said that the ruling ordered the return of the members of the board including the appellant to their work and the payment of financial entitlements to them. The court said that the documents of the case lacked  evidence that the dismissed decision caused financial damage for the appellant. The court said that the amount of money the appellant had received in exchange for the expenses he spent on lawyer was sufficient to compensate for the damage. The court said that the court had established its ruling on the grounds of solid evidence and that the appellant's defence that the compensation was not sufficient to compensate for the damage was irrelevant in this regard.

The court dismissed the appeal.
