Three appellants said in their grounds of appeal that the appealed ruling by which they were convicted of robbery had insufficient evidence of causation. They said that they had maintained before the court that the elements of the crime did not exist in the case but the court dismissed this defence.

The court of cassation said that this argument was valid. The court said that Article 175 of Kuwait Law No. 17/1960 stipulated that the ruling should include the reasons on the grounds of which the ruling was established. The court said that the ruling should include all the details available about the incident. The court said that the documents of the case revealed that the court had failed to include the details of the incident in the ruling and reasons on the grounds of which the ruling was established. The court said that the court therefore established the ruling on the grounds of an invalid basis.
