KCC 491/2012

This case involved an employee who claimed to have been dismissed without being paid their entitlement. As they had signed a final settlement it was considered that they had been paid all entitlements.

Background

An employee made a complaint to the department of labour against a company. He said that he was working for the company and that the company dismissed his from his job without paying the entitlements. The department referred the case to the court.

The court dismissed the case.

The employee appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the company should pay the employee 5053.575 Dinars.

The company appealed the ruling before the court cassation. The company said in its grounds of appeal that the appealed ruling had erred in the application of law and had insufficient evidence of causation. The company said that it maintained before the court that it had paid all the entitlements to the employee according to a final settlement by the two parties but the court dismissed this defence.
