The documents of the case revealed that the court had concluded that the appellant's claim should be dismissed due to the statute of limitations.

The court said that the appellant's request for appointing an expert in order to estimate compensation for damage resulted from the bank failure's to renew the mortgage list being a subjective request falling under  consideration of the bank's tort. The court said that the documents case revealed that the ruling was issued on 21/06/2005 and that the appellant made their case on 12/09/2011.

The court dismissed the appeal.
