KCC 384/2012

This case which involved a robbery considered if an appeal was within the deadline and the validity of witness evidence.

Background

First Appeal:

An appellant appealed the ruling before the court.

The court of cassation considered the issues related to  public order. The court said that the documents of the case revealed that the appellant had failed to introduce the reasons for his appeal within the legal deadline in violation of Article 10 of Kuwait Law No. 40/1972.

Second Appeal:

An appellant said in his grounds of appeal that the appealed ruling by which he was convicted of robbery had erred in the application of law and had insufficient evidence of causation. He said that the court had failed to indicate the evidence on the grounds of which the ruling was established.

Decision
