KCC 378/2011
This case involved a claim taken by the heirs of an employee for their father's entitlements. A key point was the calculation of his holiday pay.
Background
The heirs of an employee made a complaint to the department of labour against a company. They said that their father was working for the company and he did not received his entitlements. The department referred the case to the court. The heirs added a new defendant to the case and requested the court to order him, along with the company, to pay the entitlements.
The court dismissed the case against the added defendant and ruled that the company should pay the heirs 8953 Dinars.
The heirs and the company appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the company should pay the heirs 17353 Dinars.
The company appealed the ruling before the court of cassation. The court repealed the ruling and dismissed the appealed ruling on the value of the wage on the grounds of which the entitlements were calculated.
The company appealed the ruling before the court of cassation.
