KCC 357/2012

This case involved whether there was sufficient evidence of a drugs offence. A key issue was the validity of the inspection and arrest proceedings.

Background

An appellant said in his grounds of appeal that the appealed ruling by which he was convicted of possessing drugs for taking purposes had erred in the application of law and had insufficient evidence of causation. He said that the court failed to indicate the evidence on the grounds of which the ruling was established. He also said that he maintained before the court that the arrest and the inspections proceedings were invalid but the court dismissed this defence.
