Severance Pay – Calculation – Salary – Allowances – Employee’s Rights – Termination of Employment - Judge
This case involved the calculation of the severance pay of an individual who had been working as a judge. The severance pay had been correctly calculated based on the last salary and periodic allowances.
Background
A consultant contracted with the first defendant to work as judge and he executed his work and resigned. The settlement of the consultant's financial status included the payment of his salary but not allowances. The consultant requested the court to order the defendant to pay the differences in the severance pay after adding the value of these allowances.
Decision
The court stated the case documents revealed that the consultant had contracted with the administrative body to work as judge from 22/09/2008 to 01/04/2011 and he received severance pay calculated based on the last salary he received including periodic allowances and so the administrative body had not violated the law.
The court rejected the request.
