KCC 167/2012
This case involved a settlement document and whether it indicated an employee had agreed they had received their entitlements having been dismissed. A key point was the status of the settlement document as the employee had written on it in handwriting indicating the settlement was not yet reached.
Background
An employee made a complaint to the department of labour against a company. He said that the he was working for the company as a security guard and that he was dismissed from his job without justifications. He requested the department to order the company to pay his entitlements. The department referred the case to the court.
The court ruled that the company should pay the employee 14049 Dinars.
The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
The company appealed the ruling before the court of cassation. The company said in its grounds of appeal that the appealed ruling had erred in the application of law and had insufficient evidence of causation. The company said that the court had ignored the settlement document by which the employee admitted that he had received all his entitlements.
