The original dispute involved a claim for compensation for injuries as a result of an assault. The key issue was whether litigation procedures had been correctly followed as the claimant had not been informed of the case documents within 90 days. However, this was under court authority.

Background

A claimant filed a case against a defendant and requested the court to order the defendant to pay him compensation of 10000 Dinars for the injuries following an assault by the defendant.

The court ruled the defendant should pay the claimant 2000 Dinars in compensation.

The claimant appealed the ruling before the court of appeal. The court abandoned the appealed ruling on the rejection of the material compensation and ruled the defendant should pay an additional 500 Dinars.

The defendant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had insufficient evidence of causation and that he had maintained before the court that the case should be dismissed because he was not informed by the case document within 90 days its filing.
