KCC 586/2009
This case involved an obedience ruling over a woman in a marriage. A key point was the wife was living with the husband but had merely refused to have sex with him ,
Background
A husband filed a case against his wife before the court. He requested the wife to return to obedience housing. He said that his wife used to leave the home without his approval and that she used to prevent him from having sex with her.
The court dismissed the case.
The husband appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the wife should return to the obedience house.
The wife appealed the ruling before the court of cassation. She said in her grounds of appeal that the appealed ruling had erred in the application of law and had insufficient evidence of causation. She said that the court ordered her to return to the obedience housing though she already live dwith her husband. She said that she had prevented him from having sex with her due to a medical reason.
