Background

An employee filed a case against a defendant requesting that the court order it to dismiss a work assessment and validate her right to receive grade ‘excellent' and order the defendant to dismiss a decision which had deprived her of a promotion.

The court rejected the case.

The employee appealed and the appeal court ruled that the decision depriving her of promotion be dismissed.

The employee and defendant appealed by cassation.

Decision

Appeal No. 564 and 592/2010

The employee argued that the elementary court had failed to respond to her request for the dismissal of the working assessment despite the appealed ruling revealing that the elementary ruling had not complied with the law.

The court held that this argument was invalid as the court had concluded that the appealed decision was based on accurate components that had legal basis in the case documents.

The court therefore dismissed the appeal.
