Background
An employee filed a case against a company requesting that the court order the company to pay his salaries.
The court ruled that the company pay the employee 7233.387 Dinars.
The employee and company appealed and the appeal court ruled that the company pay 476.908 Dinars in severance and 445.114 Dinars in annual holiday pay.
The employee appealed by cassation.
Decision
Before the cassation court the employee argued that the ruling had erred in the application of law and had insufficient evidence of causation as the court had established its ruling on the employment contract having an indefinite period, but the contract period was two years.
The court held that this argument was valid as the case documents revealed that the contract was a two-year contract.
The court therefore repealed the ruling.
