Background

A claimant filed a case against defendants requesting that the court validate her right to obtain formal documents for her sons. The claimant stated that she was the ex-wife of the first defendant.

Before the cassation court the claimant argued that the ruling had erred in the application of law as her request for the validation of her right to the documents entailed that the defendant give up the needed documents.

The court held that this argument was valid and repealed the ruling.
