KCC 252/2011
Background
An employee filed a case against a company and requested the court to appoint an expert in order to estimate his dues and order the company to pay them. The employee stated he had previously made a complaint against the company and the court at the time ordered the company to give up his passport.
The court rejected the case.
The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The employee appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation because he had made a complaint against the company before the Labour Department previously and the court at the time had ruled that the company should give up his passport. The employee stated he had filed the current case in order to request different requests.
