Background
A customer filed a case (Case Number 1779/2007-Commerical) requesting the court to appoint an expert to calculate the interest rate on a loan he had borrowed from a bank, claiming the rate was not in line with Central Bank Decisions. The customer also requested that the expert estimate the damages and the compensation due to them by the bank.
The customer stated he had borrowed 70,000 Dinars from the bank which was to be paid in monthly instalments with 240 repayments of 566.60 Dinars each. However, he had found out that the amount of the repayments had increased and he claimed this violated the law.
The court appointed an expert who submitted his report and the customer also amended his requests. The court of first instance ruled that the bank did not have the right to amend the agreement by increasing the repayment period and by increasing repayment amounts.
