KCC 232/2009

This case involved a claim by an employee for his former service to be added to his current service and a nature of work allowance paid. An investigation was carried out and the employee was awarded the same salary as he had had in his previous position.

Background

A claimant filed a case against the defendants and requested the court to validate his previous career period and to add it to his service period and to order the defendants to pay him a nature of work allowance.

The court ruled that the decision made by the defendants should be dismissed and that the defendants should pay the claimant the allowance.

The defendants appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the case.

Decision

The claimant appealed the ruling before the court of cassation.

The court of cassation repealed the ruling and decided to carry out an investigation with the disputed parties.

The court then changed the appealed ruling and ruled the claimant should be received the same salary that he used to receive in his previous position.
