KCC 143/2011
This case involved whether it was possible to be charged with insulting people when the article did not actually name the victims
Background
Two appellants said in their grounds of appeal that the appealed ruling by which they were convicted of publishing an article that insulted some people had erred in the application of law. They said that the article did not mention the names of the victims.
Decision
The court of cassation said that this argument was valid. The court said that the documents of the case revealed that the article published by the appellant did not include any names of the victims. The court said that the crime of insult required directing an insult toward certain person publicly in a way that caused damage to their reputation.
The court repealed the ruling.
