Background
An employee made a complaint against an employer before the Labour Department and requested the department to order the employer to pay his salary. The department referred the case to the court.
The court ruled that the case should not be considered.
The employee appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled the employer should pay the employee 4271.360 Dinars.
Decision
The employer appealed the ruling before the court of cassation. The court of cassation repealed the ruling and then appointed an expert to consider the case.
The court then stated it would adopt the conclusions of the expert as the employee deserved to receive late wages but not holiday as he had already used them.
The court abandoned the appealed ruling and ruled that the employer should pay the employee 4214.701 Dinars.
