Evidence – Customary Document – Original – No-signature – Severance Pay – Holiday Pay – Employee –Termination of Employment – Resignation
This case involved a claim for unpaid salary by an employee. It was argued he did not deserve holiday and severance pay as he had resigned. The employee had used a customary document as evidence. This did not work as it did not include a signature and had been denied by the company. The original was requested.
Background
An employee made a complaint against a company before the Labour Department and requested the department order the company to pay his salary. The department referred the case to the court.
The court ruled the company should pay the employee severance pay of 5902.665 Dinars and holiday pay of 4930.628 Dinars.
The company appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the company should pay the employee 6447.856 Dinars.
