KCC 118/2010

This case involved whether a formal authorisation involving a company could be dismissed following a dispute.

Background

The claimants filed a case against defendants and requested the court to dismiss the procedures of the first defendant's exit from a disputed company and dismiss the formal authorization No. 478 which had been issued by the first claimant to the first defendant.

The first defendant filed a case and requested the court to dismiss the cancellation issued by the first claimant for the formal authorization.

The court rejected the case filed by the claimants and ruled that the cancellation of the formal authorization should be dismissed.

The claimants appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The claimants appealed the ruling before the court of cassation and stated in their grounds of appeal that the ruling had insufficient evidence of causation and the first claimant had used his right to dismiss the formal authorization he had granted to the first defendant because of a dispute between the two parties. The claimants stated the court dismissed the cancellation of the authorization although a ruling was issued and dismissed this authorization.
