KCC 115/2011

This case involved a claim by an employee for unpaid salary. Although the employer claimed the employment contract on which the court award had been based was fabricated it was considered as being signed by the person as it was a customary document and the signatory had not denied it was their signature.

Background

An employee made a complaint against a company before the Labour Department and requested the department order the company to pay his salary. The department referred the case to the court.

The court ruled that the company should pay the employee 12613.171 Dinars.

The company appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the company should pay the employee 11113.171 Dinars.

Decision

The company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had erred in the application of law because the court had ruled that the company should pay the employee 10000 Dinars according to the employment contract although they had maintained before the court that the contract was fabricated.
