KCC 101/2010

A case involved a dispute between an employee and a company over the payment of her salaries.

An employee filed a case against a company requesting that the court order the company to pay her salaries.

The company filed a case against the employee requesting that the court order the employee to pay an amount of money.

The court ruled that the company pay the employee 411.38 Dinars and rejected the case brought by the company.

The employee appealed and the appeal court upheld the ruling.

The employee appealed by cassation.

Decision

Before the cassation court the employee argued that the ruling had erred in the application of law and contradicted material documentary evidence as the court had rejected her requests regards the remaining contract period based on the court being unable to determine the commencement date of the contract, however, the contract had a period of two years and the commencement date was accurate in the relevant documents before the court.

The court held that this argument was valid as the case documents revealed that the contract period was two years and the company had endorsed that the employee began her employment on 01/06/2005.
