KCC 906/2010

This case involved a claim for compensation for a workplace injury. It was incorrect to order compensation be paid as the injury had not been as a result of a mistake or illegal action.

Background

A claimant filed a case against a defendant and requested the court to order the defendant to pay compensation for a workplace injury.

The court rejected the case.

The claimant appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled the defendant should pay the claimant 5000 Dinars.

Decision

The defendant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law because the claimant's injury had not been as a result of a mistake or illegal action.

The court stated this argument was valid because the claimant's injury had not been as a result of a mistake or illegal action by the defendant.

The court repealed the ruling.
