KCC 728/2001
Background
A claimant filed a case against two defendants and requested the court to validate the two contracts dated on 01/12/2009.
The court rejected the case.
The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The claimant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had insufficient evidence of causation because the court had established its ruling based on a letter sent by seller to the buyer on 06/01/2010 in which he expressed his desire to dismiss the contract and that the delay by the claimant in responding to this letter was considered an acceptance of the dismissal of the contract although this delay should not be considered so.
