KCC 44/2010

A case involved a dispute between an employee and a company over the payment of her salaries.

Background

An employee filed a case against a company requesting that the court order the company to pay her salaries.

The court rejected the case.

The employee appealed and the appeal court upheld the ruling.

The employee appealed by cassation.

Decision

Before the cassation court the employee argued that the ruling had contradicted material documentary evidence as the court had established its ruling on the company having paid the employee her dues, however, this transaction took place a year before the termination of her contract.

The court held that this argument was valid and repealed the ruling.
