A case involved a dispute between an employee and a bank over the payment of his salaries.

Background

An employee filed a case against a bank requesting that the court order the bank to pay his salaries.

The court ruled that the bank pay the employee 7995.765 Dinars.

The employee and bank appealed and the appeal court ruled that the bank pay the employee 6757.926.

The employee and bank appealed by cassation.

Decision

Before the cassation court the parties argued that the ruling had erred in the application of law and contradicted material documentary evidence as the court established its ruling on an expert report, however both parties objected to the report's conclusions.

The court held that this argument was invalid as the court has the authority to consider all aspects of a case and evaluate the evidence before it in order to establish its ruling. The court stated that it is not obliged to consider the objections of the disputed parties if it is persuaded by the reasons for its ruling.

The court therefore dismissed the appeals.
