This case involved disputed real estate and the rent and compensation owed. A key issue was the status of the ruling as the judges who had issued the ruling had signed the last page of the ruling which had been separated from other parts of the ruling.
Background
The claimants filed a case against defendants and requested the court to appoint an expert in order to review a disputed real estate and estimate the rent they deserved and to order the defendants to pay accordingly.
The court ruled that the defendants should pay 17062.50 Dinars to the first claimant and 8531.250 Dinars to the second claimant and rent of 181.176 Dinars to the first claimant and 90.588 Dinars to the second claimant.
The claimants appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the defendants should pay the rent of 411.764 Dinars to the first claimant and 205.882 Dinars to the second claimant.
Decision
The defendants appealed the ruling before the court of cassation.
