Background
A claimant filed a case against an airline company and requested the court to order the company to pay him amount of money as compensation for a flight delay from Cairo to Kuwait.
The court ruled that the company should pay the claimant 500 Dinars.
The claimant and the company appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the case.
Decision
The claimant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law and stated the problem in the ariplane's engine of the plane was to be expected as the company's fleet was old.
The court stated this argument was valid and that the accident which had happened and delayed the flight was not a sudden accident and was expected as the company fleet was old.
The court repealed the ruling.
