KCC 14/2011

This case involved whether there was evidence of a drug and alcohol offence. The arrest procedures were valid as the police officer who arrested the individual was present at the time of the incident.

Background

An appellant said in his grounds of appeal that the appealed ruling by which he was convicted of possessing drugs for taking purposes and drinking alcohol in a public place had erred in the application of law and had insufficient evidence of causation. He said that the court had failed to indicate the evidence on which it had established the ruling. He also said that he had maintained before the court that the inspection and the arrest proceedings were invalid but the court dismissed this defence.
