KCC 119/2011

This case involved a claim by a retired employee for an increase in his pension as some employees had received this. Evidence showed the increase had only been given to those in employment and was not relevant to retired employees.

Background

An employee made a complaint against a company before the Labour Department and stated that he used to work with the company and he had retired. The employee stated the company had increased the retirement salary for some employees but he had not received the increase. The department referred the case to the court.

The court refused to consider the case due to the statute of limitations.

The employee appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the case.

Decision

The employee appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law because the court had concluded that the increase was just for working employees although the increase should also have covered retired employees.
