KCC 105/2010

A case involved a dispute between an employee and a company over the payment of his salaries.

Background

An employee filed a case against a company requesting that the court order the company to pay his salaries.

The court ruled that the company pay the employee the stipulated amount in the case documents.

The employee and company appealed and the appeal court ruled that the company pay the employee 7638.897 Dinars.

The company appealed by cassation.

Decision

Before the cassation court the company argued that the ruling had insufficient evidence of causation as it had maintained before the court that the employment contract was an indefinite period contract and thus the employee did not deserve compensation for termination of the contract.

The court held that this argument was valid as the parties had agreed to a one year contract with automatic renewal for the same period, thus the contract was for an indefinite period.

The court therefore repealed the ruling.
