KCC 100/2010
This case involved an individual accused of fabricating an educational certificate and if there was sufficient evidence.
Background
An appellant said in his grounds of appeal that the appealed ruling by which he was convicted of fabricating a formal document and attempted fabrication had insufficient evidence of causation. He said that the elements of the two crimes did not exist in his case. He said that the court established its ruling on the grounds of weak evidence.
Decision
The court of cassation said that this argument was invalid. The court said that the court considered all aspects of the incident and concluded that the elements of the crimes existed in the case. The court said that the documents of the case revealed that the appellant had fabricated an educational certificate and tried to approve it with the Ministry of Education. The court said that the court established its ruling on the grounds of solid evidence including the testimonies of the officers of the ministry. The court said that the appellant's defence was irrelevant in this regard.
The court dismissed the appeal
