KCC 66/2010

A case involved a dispute between an employee and a company over the payment of his salaries.

Decision

Before the cassation court the employee argued that the ruling had erred in the application of law as the court had established its ruling on the employee having reached final settlement with the company for the payment of all his salaries, however, the court had ignored documents he provided stating otherwise.

The court held that this argument was valid as the court had ignored the employee's defence despite it being a substantial one that may have altered the ruling outcome.

The court therefore repealed the ruling.
