KCC 64/2009

A case involved a dispute between an employee and two companies over the payment of compensation for an injury sustained during the course of his employment.

Background

An employee filed a case against two companies requesting that the court order the companies to pay him compensation for an injury sustained at work.

The first company filed a case against the second company requesting that the court order the second company to pay the compensation amount.

The court ruled that the first company pay the employee 12493.170 Dinars and that the second company pay the first company this amount.

Both companies appealed and the appeal court upheld the ruling.

The first company appealed by cassation.

Decision

Before the cassation court the company argued that the ruling had erred in the application of law as the employee had not been injured during the course of his work and had already received compensation from the second company. Furthermore, that the employee had signed two final settlement documents in which he endorsed receiving all his salaries.
