Background
An employee filed a case against two defendants requesting that the court order the defendants to pay his salaries.
The court rejected the case for not being filed in accordance with the relevant legal procedures.
The employee appealed and the appeal court upheld the ruling.
The employee appealed by cassation.
Decision
Before the cassation court the employee argued that the ruling had erred in the application of law and had insufficient evidence of causation as he had brought his complaint before the Labour Department in a previous case.
The court held that this argument was invalid as the bringing of a complaint before the Labour Department is in accordance with the procedures that should be followed before the filing of a case. The court stated that the previous case had been rejected and thus should be considered cancelled, including the complaint brought before the Labour Department.
The court therefore dismissed the appeal.
