KCC 289/2008
Background
An employee made a complaint against a company and requested the Labour Department to order the company to pay his dues. The department referred the case to the court.
The court ruled the company should pay the employee 8615.099 Dinars plus pay 300 Dinars in lawyer's expenses.
The employee and the company appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled that the company should pay the employee 8474.530 Dinars.
Decision
The employee and the company appealed the ruling before the court of cassation.
The court of cassation dismissed the appeal made by the company.
The employee stated the ruling had violated the law because the court had rejected his appeal against the estimation of the lawyer's expenses based on the argument that he should have made a plea instead of filing the appeal although he should be able to appeal the ruling according to the relevant laws.
