KCC 284/2008

This case involved a claim by an employee for unpaid dues. The court ordered an investigation and it was proved the employee had violated company statutes and caused the company losses so dismissal was fair.

Background

An employee filed a case against a company and requested the court to order the company to pay his dues.

The court refused to consider the case.

The employee appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled the company should pay the employee 8387.539 Dinars.

Decision

The company appealed the ruling before the court of cassation.

The court of cassation repealed the ruling and decided to make investigations with the employee.

The investigation revealed that the employee had violated the company statute and caused massive losses to the company. The company had dismissed him from his job according to Article 55 of the Labour Law in the Civic Sector.

The court repealed the ruling and rejected the case.
