KCC 225/2007/1

This case involved a claim by an employee for compensation for an occupational disease. Two insurance companies were added to the case but they were not liable as the disease had happened because the insurance contract came into force.

Background

An employee filed a case against two companies and requested the court to order the companies to pay her compensation for disability which had resulted from a disease. The first company added two insurance companies to the case and requested the court to order them to pay the value of compensation.

The court rejected the two cases.

The employee and the first company appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The employee appealed the ruling before the court of cassation.

The court repealed the ruling before the court of cassation and referred the court of appeal.

The court of appeal stated that the case made by the employee had no legal basis because the case documents showed the disability had happened before the insurance document came into force.

The court rejected the case.
