This case involved whether an individual had been libelled in some articles. In another appeal the appeal procedures were considered.

Background

First Appeal:

An appellant appealed the ruling before the court of cassation.

The court of cassation considered the issues related to the public order. The court said that the documents of the case revealed that the appeal document introduced by the appellant was not signed by a lawyer in violation to Article 10 of Kuwait Law No. 40/1972.

Second Appeal:

The office of public prosecution said in its grounds of appeal that the appealed ruling by which the two convicted persons were acquitted of publishing insulting articles against the victim had erred in the application of law and had insufficient evidence of causation. The office said that the articles included insulting phrases that affected the victim's reputation.
