This case involved a claim from a defendant to pay an amount and for their insurer to reimburse them. The insurance company tried to wrongly claim they were not due to reimburse the money as the defendant had not complied with their recommendations according to two agreements.
Background
A company filed a case against two defendants and requested the court to order them to pay an amount of money and legal interest.
The second defendant (a company) filed a case and requested the insurance company to pay the amount.
The court ruled that the second defendant should pay the company 53063.359 Dinars and the insurance company should pay the second defendant this amount.
The second defendant and the insurance company appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the second defendant should pay the company 41233 Dinars and 7% legal interest and that the insurance company should pay the second defendant the mentioned amount.
