Background

A company filed a case against two defendants and requested the court to order the defendants to pay an amount of money and legal interest. The company stated it had paid the amount of to two individuals who had suffered damages and it had the right to claim the compensation amount back from the defendants.

The court rejected the case against the second defendant and ruled the first defendant should pay the company 26420 Dinars and 7% legal interest.

The first defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The first defendant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had insufficient evidence of causation and had violated the right of defence because the court had ignored the arguments and documents the defendant had introduced in order to support his claims.
