Background
An employee made a complaint against a company and requested the Labour Department to order the company to pay her dues. The department referred the case to the court.
The court ruled that the company should pay the employee 7909.38 Dinars.
The company appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled that the company should pay the employee 349.38 Dinars.
Decision
The employee appealed the ruling before the court of cassation and stated in her grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation as the company had terminated the contract the employee deserved compensation.
The court stated this argument was valid because the employment contract agreed by the two parties stipulated that if the employer terminated the contract, the employer was obliged to pay compensation to the employee.
The court repealed the ruling.
