KCC 202/2008/1

This case involved a claim for personal injury compensation by heirs of a man who had been killed in a road traffic accident on his way to work. The key issue in this case was whether the ruling was illegal as one of the judges who attended the pleading session had not attended the session when the ruling was issued.

Background

The heirs of an employee made a complaint against a company and stated that their father had died in car accident while he was going to work and the company had refused to pay his dues. The Labour Department referred the case to the court.

The heirs added the insurance company to the case as a defendant.

The company filed a case against the insurance company and requested the court to order the insurance company to pay the compensation.

The court ruled that the company should pay the heirs 10135.137 Dinars in blood money and severance pay and the insurance company should pay the company 10000 Dinars.

The insurance company appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The insurance company appealed the ruling before the court of cassation.
