Background
A company filed a case against a defendant and requested the court to order the defendant to pay an amount of money and the legal interest. The company stated that the defendant had failed to commit to his obligations according to the agreed contract.
The court ruled the defendant should pay the company 26546.520 Dinars.
The defendant appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled that the company should pay the defendant 94792.285 Dinars.
The company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had erred in the application of law because the amount the court had ordered the company to pay exceeded the value of defendant's requests. The company also stated the court had ordered the company to pay amounts that the defendant had not requested.
