KCC 152/2007
Background
A claimant filed a case against defendants requesting that the court dismiss a decision which had suspended him from his job.
The court rejected the case.
The claimant appealed and the appeal court ruled that the decision be dismissed.
The defendants appealed by cassation.
Decision
Before the cassation court the defendants argued that the ruling had erred in the application of law as Article 21 of Kuwait Law No. 53/2001 permitted the Minister of Interior to suspend the work of the claimant during an investigation into a crime he was allegedly involved in. Therefore, there was no need to apply the laws relating to the civil service.
The court held that this argument was valid as the claimant's case was regulated by a certain law, therefore the laws of the civil service could not be applied.
The court therefore repealed the ruling.
