Background
A claimant filed a case against a defendant requesting that the court dismiss a decision and order the defendant to pay him compensation.
The court ruled that the claimant had the right to receive the allowances applicable to his previous position.
The claimant and defendant appealed and the appeal court abandoned the ruling and rejected the case.
The claimant appealed by cassation.
Decision
Before the cassation court the claimant argued that the ruling had erred in the application of law as the court had violated the previous ruling which stipulated that employees of the general department of investigations deserved such allowances.
The court held that this argument was invalid as Article 24 of Kuwait Law No. 53/2001 stipulated that the maintenance of the period of seniority should not concern financial dues.
The court therefore dismissed the appeal.
