KCC 638/2007

This case involved a request for an expert to be appointed to assess personal injury compensation. A claim for transportation costs while the individual had been receiving medical treatment for the injury had been rejected but this was because evidence of their existence had not been provided.

Background

A claimant filed a case against a defendant and requested the court to appoint an expert in order to determine his injuries and estimate the final compensation he deserved.

The court ruled that the defendant should pay the claimant 8000 Dinars.

The claimant and the defendant appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the defendant should pay the claimant 7000 Dinars.

Decision

The claimant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law because the court had rejected his request for compensation transportation expenses he had paid during the treatment including flight tickets.

The court stated this argument was invalid and that the court had rejected the request because the claimant had failed to provide the relevant documents which confirmed he had paid the transportation expenses.
