KCC 477/2001

This case involved fees due to a lawyer who had been authorised to conduct litigation and paid in advance but the litigant had then decided not to take the case.

Background

A claimant filed a case against defendants before the court. She requested the court to order the defendants to pay her 100000 Dinars. They said that a dispute existed between with her husband and that she assigned the defendants to defend her case before the court. She then requested them not to file her case and to repay the amount as she had paid in advance but they refused to do so.

The defendants filed a case against the claimant before the court. They requested the court to order the claimant to pay them the remaining value of the contract of 20000 Dinars.

The court dismissed the defendants' case and ruled that the defendants should pay the claimant 5000 Dinars.

The claimant and the defendants appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the claimant should pay the defendants 20000 Dinars.
