Employee’s Rights – Salary – Nightshift Work – Overtime – Evidence – Contract – Remedy - Court
This case involved a claim by an employee for unpaid salary. The employee provided a copy of a document that proved he had worked a night shift. Overtime had not be assigned in a written document and the company had denied the copy of the document so the appeal was dismissed. The court had authority to decide from the evidence if the employee had been damaged by termination of the contract.
Background
An employee made a complaint against a company and requested the Labour Department to order the company to pay his salary. The department referred the case to the court.
The court rejected the appeal.
The employee appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled the company should pay the employee 3385.915 Dinars.
Decision
The employee and the company appealed the ruling before the court of cassation.
